A divorce can sometimes be extremely stressful and confusing, as both divorcing spouses have a lot at stake and often times have very different ideas as to what is acceptable to them in order to achieve a successful divorce. A divorce will directly affect both parties financially and emotionally, not to mention the affect a divorce will have on children who are also involved.
There are three types of divorce proceedings:
An annulment is not really a divorce, although it does dissolve a marriage. However, annulments basically treat the marriage as though it never happened. Annulments are difficult to get, particularly if the marriage is long. Grounds for annulment may include: misrepresentation or fraud, concealment, refusal or inability to consummate the marriage, or a misunderstanding
An Uncontested Divorce is a proceeding in which the person that is sued for divorce does not fight it and instead reaches an agreement with the spouse during the proceedings. In these cases, the terms of the divorce are agreed upon by both parties. Uncontested divorces are generally much more amicable and economical than other types of divorce.
In a Contested Divorce the person sued for divorce decides to fight the terms of the marriage disillusion and is unable to reach an agreement with the spouse during the proceedings. In a contested divorce, both parties may enter into divorce mediation willfully or be ordered to do so by the presiding judge. Divorce mediation is the process of bringing both parties and their attorneys in front of a mediator for the purpose of helping to resolve specific issues that are currently being contested in thedivorce.
There are many issues that may need to be either amicably resolved or ruled upon by the court in order for a divorce to be finalized. Some of these additional Family Law issues that may need to be addressed in a divorce may include:
